Laws in the United States - UIGEA

In the USA online gambling is controlled by the Unlawful Internet Gambling Enforcement Act (UIGEA).  The act allows each State to make their own decisions about online gambling.  This right is granted to each State under the Tenth Amendment to the Constitution which states, “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”  Each State retains its sovereignty, freedom, and independence, and every power, jurisdiction, and right, which is not by this Confederation expressly delegated to the United States, in Congress assembled.

UIGEA places restriction on financial institutions from dealing directly with online gambling sites.  It makes exceptions for the individual States to offer online gambling when bets are purchased within the State and there is no cross over in play amongst States.

Personally we think this is mostly great.  States may offer Game With Us right now, however some will need to introduce new Bills within their State for they have already passed certain laws curtailing this activity.  Lotto IP has not only contacted all the lottery corporations but also all Members of Congress.  Congress is looking to fix what is currently clearly broken with UIGEA and may look to mistakenly regulate online gambling.  Clearly in our view this would be a major mistake to just “regulate” when you can “operate”.  We need Congress to make the right national choice and just ease restrictions by about two sentences, allowing for cross over, as long as the ticket was purchased (bet was initiated and redeemed) within the State it is redeemed.

Lotto IP is looking for more State Representatives to write Bills within their State so the lotteries can have their way and offer Game With Us.  Each State already has Gaming Commissions that oversee the lotteries and these commissions can oversee Game With Us within each jurisdiction.
